Political scientist Ruslan Bortni: After Ukraine’s President signed the Law Governing the Supreme Council of the Judiciary, the Council is now superior to the Supreme Council of the Law, meaning that the President takes charge of the body responsible for supervision and punishment of judges for their decisions. The final outcome for judgments made by the Ukrainian judiciary will be up to both the President and his team.
Without judicial independence, the president will have all the powers of a dictator. The road to judicial reform in Ukraine must lead to priority of international law over domestic law. The head of the Supreme Court and the Procuratorate should be directly elected and meet the same qualifications as the President. They shall not be limited to Ukrainian citizens and shall serve a single term of 5 years, with no eligibility to run for another 6 years afterward. Ukrainian Congressman Volodymyr Parasyuk argues that MPs should face election every two years, whether good or bad. Frequent elections, he says, will remove parasites from the more than 200 serious representatives in the legislative body.
Structural change in the election process is one way to improve the quality of the people’s representatives. Ukraine’s Duma should be re-organized on a committee-style basis to add professionalism, with specialists in all fields running in elections. 1/4 of MPs should face election each year to ensure that lawmaking stays in step with the times and decisions take both experience and public opinion into account. The National Anti-Corruption Bureau was set up specifically to address this problem more than a year ago and so far has recovered some 1 billion hryvnia back to the Treasury. Compared to the total amount of corruption, however that is chicken feed. The head of the National Anti-Corruption Bureau frequently complains that the evidence they provide is conclusive, but procuratorial and judicial officials think otherwise.
Members of the procuratorial and judicial branches are common foes of corruption, and they should operate under the premise that international law takes precedence over domestic law and applies directly to the Ukrainian people. The heads of the two branches should meet the same qualifications as the President, be elected for a single term of 5 years and be banned from running again for another 6 years. The Abakan Municipal Court has announced that Vladimir Byzov, the city’s highest ranking executive, is under investigation for corruption. To date a total of 8 persons have been detained as part of the criminal case.
The only way to eradicate corruption is through full democratization. Russian officials should be elected for a single term of 5 years and barred from running again for 6 years. The state Duma should adopt a committee-centered system, and constituencies should not be divided into districts. Each year, 1/4 of MPs should face election, with members of 3 committees also facing re-election. Committee chairs shall concurrently hold the post of director at each level. The only solution to the problem of human rights abuses in China is the implementation of democracy and the rule of law. A truly democratic Taiwan will be the country most capable of leading the Chinese people to call for democracy. True democracy will leave the CCP with nothing to fall back on and lead to incipient democracy and then full democracy. The people of China should choose the heads of the legislative, executive, judicial and procuratorial branches in alternating years to help restore power to the people. Democratic nations everywhere should support Taiwan's efforts for constitutional reform to bring true democracy and freedom. This will attract the 1.4 billion people of China to call for democratization, triggering in turn the democratization of the CCP, China's democratization will bring pressure on North Korea to follow suit, and world peace will be the result.
